Abstract:

The course "European and International Monetary Law" is aimed at students of law, international economics as well as Governance/Public Policy programs and provides special and in-depth knowledge of International and European Monetary Law. The course is taught in English. Upon successful completion the awarded credit points can be used to acquire the "Pflichtfremdsprachenschein" (§ 24 II JAPO), the "Certificate of Studies in European, Comparative and International Law" (CECIL) or – within the scope of the respective study regulations - towards the degrees “International Economics” and “Governance and Public Policy” (University of Passau) and the "Europajurist" program (University of Würzburg).
The course is divided into three parts: The first part consists of one unit and contains an interdisciplinary introduction to money and currencies. It provides course participants with the requisite know-how for a comprehensive understanding of the economic and legal principles underlying European and International Monetary Law in terms of the history of money, monetary policy basics and the relationship between money and the law. It explains the basic ideas and principles relevant to this course. The second part consists of five units and focuses on International Monetary Law. Based on a study of the principle of monetary sovereignty and an overview over the historical background of international monetary law (gold standard, founding of the BIS and the IMF, further reforms of the IMF framework in particular during the 1970ies), the core issues of international monetary relations will be examined. Resulting from the interaction between different monetary systems, those issues are: Convertibility of currencies, free movement of capital and payments, choice/establishment of an exchange rate regime, providing adequate international liquidity and the trilemma of monetary policy. Subsequently, the content and scope of the substantive rules governing the institutional design and working of the IMF will be covered in detail. This includes an analysis of the IMF Articles of Agreement with special focus on institutional design and decision-making within the IMF as well as the substantive legal obligations of Member States. The third and final part consists of eight units and presents a detailed study of European Monetary Law (European Economic and Monetary Union (EMU)). Following an outline of the history of monetary integration in Europe and the evolution of the European Economic and Monetary Union, the legal post-Lisbon framework of EMU will be examined, in particular the institutional setup and the substantive legal rules that shape EMU. Finally, attention will be given to the incident that shook EMU to its very foundations: The sovereign debt crisis and the measures taken to fight it by the various actors involved. The course will then conclude with an in-depth analysis of the legality and consequences of crisis-related measures.
Learning Objectives: Law students will be equipped with a basic understanding and knowledge of the structure and functioning of modern monetary systems as well as the fundamental legal frameworks that govern them at international and European level. This will enable them to independently and critically assess developments and issues in this particular field from a legal point of view on the basis of EU and International Law. Students of International Economics and of Public Policy/Governance will be able to describe and understand International and European Monetary Law from a legally informed perspective and therefore assess issues in monetary law from a basic legal point of view. They will have broadened their existing knowledge in the fields of Economics and Political Science by an interdisciplinary approach to international monetary relations.
